ORDER MODIFYING OPINION AND DENYING REHEARING

THE COURT:

It is ordered that the unpublished opinion filed herein on May 17, 2012, be modified as follows:

On page 41, the parenthetical description “(forcible sodomy)” is added to the end of the first sentence of the last paragraph of the opinion, so the sentence reads as follows:

“The judgment shall be modified to strike the true finding on the second sodomy count (forcible sodomy).”

There is no change in the judgment.

Respondent’s petition for rehearing is denied.
