Los Angeles County Super. Ct. No. PA057565

ORDER MODIFYING OPINION

THE COURT:

GOOD CAUSE appearing, the opinion filed on January 24, 2011, in the above-entitled matter is hereby modified as follows:

1. On page 11, lines 17 through 22, the following two sentences are deleted: “Appellant appeared at a November hearing, and the prosecution began looking for him right after his first nonappearance. Because trial did not occur in January and officers spent the two months between appellant’s no-show and the actual trial date searching for him, appellant’s claims that they should have served him or apprehended him prior to the January date is not persuasive.”

The following two sentences are inserted in their place: “Ostos appeared at a November hearing, and the prosecution began looking for him right after his first nonappearance. Because trial did not occur in January and officers spent the two months between Ostos’s no-show and the actual trial date searching for him, appellant’s claims that they should have served Ostos or apprehended him prior to the January date is not persuasive.”

There is no change in the judgment.

RUBIN, Acting P. J. FLIER, J.
