ORDER MODIFYING OPINION

The opinion filed in this matter on November 21, 2008, is modified as follows:

On page 24, in footnote 7, in the sentence beginning “The court did not hold or imply,” the word “only” is deleted so the sentence reads:

The court did not hold or imply that lesser conduct could not warrant the use of that epithet as well.

Except for this modification, the opinion remains unchanged. This modification does not effect a change in the judgment.
