On order of the Court, the delayed application for leave to appeal from the July 11, 2000, decision of the Court of Appeals, is considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we DIRECT, within 56 days of this order, the prosecutor to file a supplemental answer to the delayed application for leave to appeal, specifically addressing the factual argument made by defendant in Issues I, II, and III that defendant's participation in the beating occurred only after the victim was already dead. Plaintiff may refer to evidence developed in the prosecution of co-defendants DeJesus and Hayes. If plaintiff does so, plaintiff is further directed to provide full copies of any transcripts cited.

We retain jurisdiction.
