Sep 6, 2005
21 A.D.3d 911 (N.Y. App. Div. 2005)

Opinion

2002-06986.

September 6, 2005.

Appeal by the defendant from a judgment of the Supreme Court, Kings County (DiMango, J.), rendered December 11, 2001, convicting him of criminal sale of a controlled substance in the third degree, upon his plea of guilty, and imposing sentence.

Lynn W. L. Fahey, New York, N.Y., for appellant.

Charles J. Hynes, District Attorney, Brooklyn, N.Y. (Leonard Joblove and Maria Y. Park of counsel), for respondent.

Before: Prudenti, P.J., Schmidt, Santucci, Luciano and Spolzino, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v. California, 386 US 738; People v. Paige, 54 AD2d 631; cf. People v. Gonzalez, 47 NY2d 606).
