Appellant having moved to consolidate the appeal taken from a judgment of the Livingston County Court rendered June 9, 2009 (KA 09-01253), with a motion seeking to renew and/or reargue the orders of Livingston County Court dated August 18, 2010 and November 9, 2010, denying his CPL article 440 motions,
Now, upon reading and filing the affidavit of Jesse Roberites sworn to October 2, 2012, the notice of said motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is denied.
