People v. Rivera

Appellate Division of the Supreme Court of New York, Second Department
Oct 14, 1997
243 A.D.2d 587 (N.Y. App. Div. 1997)

Opinion

October 14, 1997

Appeal from the Supreme Court, Kings County (Hall, J.),

Ordered that the judgment is affirmed.

Viewing the evidence in the light most favorable to the prosecution ( see, People v. Contes, 60 N.Y.2d 620), it was legally sufficient to establish the defendant's guilt beyond a reasonable doubt. Moreover, upon the exercise of our factual review power, we are satisfied that the verdict of guilt was not against the weight of the evidence ( see, CPL 470.15).

The defendant's remaining contention is without merit ( see, People v. Carlstrol, 231 A.D.2d 646).

O'Brien, J.P., Santucci, Joy and Altman, JJ., concur.
