Appellate Division of the Supreme Court of New York, Second Department
Nov 4, 2009
67 A.D.3d 711 (N.Y. App. Div. 2009)

Opinion

No. 2007-11169.

November 4, 2009.

Appeal by the defendant from a judgment of the County Court, Suffolk County (Gazzillo, J.), rendered October 30, 2007, convicting him of burglary in the second degree, upon his plea of guilty, and imposing sentence.

Robert C. Mitchell, Riverhead, N.Y. (Alfred J. Cicale of counsel), for appellant, and appellant pro se.

Thomas J. Spota, District Attorney, Riverhead, N.Y. (Thomas C. Costello of counsel), for respondent.

Before: Fisher, J.P., Florio, Angiolillo, Eng and Roman, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631; cf. People v Gonzalez, 47 NY2d 606).

This defendant has not, nor could he have, raised any nonfrivolous issues in his supplemental pro se brief.
