People v. Rivera

Appellate Division of the Supreme Court of New York, First Department
Nov 6, 2003
1 A.D.3d 132 (N.Y. App. Div. 2003)

Opinion

2119

November 6, 2003.

Judgment, Supreme Court, Bronx County (Lawrence Tonetti, J.), rendered December 19, 2001, convicting defendant, upon his plea of guilty, of burglary in the second degree, and sentencing him, as a second felony offender, to a term of 6 years, unanimously affirmed.

Lara R. Binimow, for respondent.

Mark W. Zeno, for defendant-appellant.

Before: Nardelli, J.P., Mazzarelli, Andrias, Sullivan, Lerner, JJ.

The record establishes that defendant knowingly, intelligently and voluntarily waived his right to appeal, including his right to challenge his sentence as harsh and excessive (see People v. Moissett, 76 N.Y.2d 909). In any event, were we to find the appeal waiver to be invalid, we would perceive no basis for reducing the sentence.

THIS CONSTITUTES THE DECISION AND ORDER OF THE SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
