People of Michigan v. Brad Allen Risner

LC No. 2020-003135-FC

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.203(F)(1), orders:

The claim of appeal is DISMISSED for lack of jurisdiction because the June 15, 2023 judgment of resentence is not a final judgment appealable by right. MCR 7.203(A)(1); MCR 7.202(6)(b). Specifically, the June 15, 2023 judgment of resentence was not entered following a remand from a prior appeal of right. MCR 7.202(6)(b)(iv). The June 15, 2023 judgment of resentence was entered on remand from a current, ongoing appeal of right in this Court in Docket No. 359368. This Court retained jurisdiction in that appeal and that appeal will proceed.
