Opinion

No. 121486.

November 19, 2002.

COA: 234060, Livingston CC: 96-009564-FH

On order of the Court, the application for leave to appeal from the April 18, 2002 decision of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.

Cavanagh and Kelly, JJ., would remand this case to the Livingston Circuit Court with directions that the court entertain defendant's challenges to the criminal history portion of his presentence report.
