An order of this Court having been entered on August 6, 2020 (M-1849), granting defendant poor person relief and assigning Stephen Chu, Esq,, Office of the Appellate Defender, as defendant's counsel to prosecute the appeal taken from a judgment of the Supreme Court, New York County, rendered on or about April 19, 2017,

And Stephen Chu, Esq., having moved for an order relieving him as assigned counsel for defendant-appellant, and for other relief, on the ground that the defendant's conviction and sentence were affirmed by order of this Court entered May 30, 2019 (Appeal No. 9506),

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that the motion is granted to the extent that the order of this Court entered August 6, 2020 (M-1849) is hereby recalled and vacated. ENTERED: December 03, 2020
