Appeal from a judgment of the Supreme Court, Erie County (M. William Boller, A.J.), rendered February 15, 2019. The judgment convicted defendant, upon a plea of guilty, of attempted burglary in the third degree.

Now, upon reading and filing the stipulation of discontinuance signed by the defendant on February 28, 2021, and by the attorneys for the parties on March 10 and 17, 2021, It is hereby ORDERED that said appeal is unanimously dismissed upon stipulation.
