DECISION & ORDER ON MOTION
Appeal, by permission of a Justice of this court, from an order of the Justice Court of the Town of Pleasant Valley, Dutchess County, dated August 20, 2015 (appeal No. 2015-2243 D CR). Separate appeal, by permission of a Justice of this court, from an order of the Justice Court of the Town of Pleasant Valley, Dutchess County, dated October 30, 2015 (appeal No. 2015-2673 D CR).
On the court's own motion, it is
ORDERED that the appeal from the order dated August 20, 2015 is dismissed, as that order was superseded by the order dated October 30, 2015, made upon reargument; and it is further,
ORDERED that the brief filed under appeal No. 2015-2243 D CR is deemed filed under appeal No. 2015-2673 D CR and that appeal is deemed perfected; and it is further,
ORDERED that respondent shall have 21 days from the date of this decision and order on motion in which to serve and file a respondent's brief; and it is further,
ORDERED that appellant shall have 14 days from the date that the respondent's brief is due to be served and filed pursuant to this decision and order on motion in which to serve and file a reply brief.
