ORDER

The motion to remand is DENIED.

The motion for leave to supplement the motion to remand is DENIED.

The delayed application for leave to appeal is DENIED for lack of merit in the grounds presented.

Shapiro, P.J., would grant leave to appeal and remand for a Ginther hearing as a review of the plea transcript demonstrates that while a factual basis was established to accept a plea of guilty to unarmed robbery, a factual basis as to armed robbery was not established.
