People v. Reeves

Court of Appeals of the State of New York
Apr 25, 1978
377 N.E.2d 480 (N.Y. 1978)

Opinion

Argued March 20, 1978

Decided April 25, 1978

Appeal from the Appellate Division of the Supreme Court in the Third Judicial Department, RAYMOND J. MINO, J.

Donald E. Nawi and Gilbert S. Rosenthal for appellant.

Francis J. Vogt, District Attorney (E. Michael Kavanagh and Edward M.P. Greene of counsel), for respondent.

Order affirmed on the memorandum at the Appellate Division ( 57 A.D.2d 1015), noting, as did the Appellate Division, that the finding of a hashish pipe and some hashish on the table would not alone have justified the issuance of a warrant of such breadth.

Concur: Chief Judge BREITEL and Judges JASEN, GABRIELLI, JONES, WACHTLER, FUCHSBERG and COOKE.
