PEOPLE OF MICHIGAN v. TIFFANY REED

LC No. 19-005789-01-FC

Christopher P. Yates Presiding Judge Mark T. Boonstra Sima G. Patel Judges

ORDER

The motion for immediate consideration is GRANTED.

Pursuant to MCR 7.205(E)(2), in lieu of granting the application for leave to appeal, we REVERSE the Wayne Circuit Court's October 16, 2024 order denying the stipulated motion to adjourn trial and REMAND for further proceedings consistent with this order. The parties established good cause for the requested continuance, and the trial court abused its discretion by nevertheless denying their stipulated motion to adjourn trial. On the record that is currently available, "[w]e do not know whether docket management considerations motivated the denial of a continuance in this case. We take this opportunity to remind the bench, however,... that the desire ... to expedite court dockets is not a sufficient reason to deny an otherwise proper request for a continuance." See People v Jackson, 467 Mich. 272, 279 n 7; 650 N.W.2d 665 (2002).

In light of the foregoing, the motion for peremptory reversal is DENIED as moot. This order is to have immediate effect. MCR 7.215(F)(2). We do not retain jurisdiction.
