PRESENT: , SMITH, CENTRA, PERADOTTO, AND CARNI, JJ.

Counsel for appellant having moved for permission to withdraw as assigned counsel on an appeal taken from a judgment of Onondaga County Court, rendered June 26, 2012, on the ground that appellant has abandoned the appeal, and respondent having moved to dismiss the appeal taken from the judgment of Onondaga County Court, rendered June 26, 2012,

Now, upon reading and filing the affirmation of Kristen McDermott, Esq. dated March 26, 2015, the affirmation of James P. Maxwell, Esq. dated March 31, 2014, the notices of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion of appellate counsel is granted to the extent that Susan R. Horn, Esq. is relieved of her assignment, and

It is further ORDERED that the motion of respondent is granted and the appeal is dismissed.
