Appeal from Albany County Court.


Appeal dismissed with leave to reinstate upon presenting proper record which shall show proof concerning the earlier conviction of murder in Georgia; also the minutes of the original sentence and the proceedings and minutes of the resentence. Such record shall be filed on or before February 15, 1943. It is recommended that the District Attorney furnish these records to the appellant to aid him in presenting a record on appeal. Hill, P.J., Crapser, Bliss, Schenck and Foster, JJ., concur.
