Appeal from County Court of Kings County.


Order modified on the law by inserting a provision denying the motion to dismiss counts 1 and 3 of the indictment. As so modified, the order, insofar as appealed from, is affirmed. See People v. Rabinowitz ( ante, p. 793), decided herewith. Nolan, P.J., Carswell, Johnston, Adel and Wenzel, JJ., concur. [ 196 Misc. 304.]
