Appellate Division of the Supreme Court of New York, Second Department
Mar 27, 2007
38 A.D.3d 923 (N.Y. App. Div. 2007)

Opinion

No. 2006-06316.

March 27, 2007.

Appeal by the defendant from a judgment of the County Court, Orange County (DeRosa, J.), rendered June 14, 2006, convicting him of criminal sale of a controlled substance in the third degree, upon his plea of guilty, and imposing sentence.

John P. Savoca, White Plains, N.Y., for appellant.

Francis D. Phillips II, District Attorney, Goshen, N.Y. (Daniel M. Reback of counsel), for respondent.

Before: Crane, J.P., Santucci, Florio, Dillon and Balkin, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631 [1976]; cf. People v Gonzalez, 47 NY2d 606).
