People of Michigan v. John Travis Randolph
LC No. 2021-000104-FC
ORDER
Michael F. Gadola, Chief Judge Pro Tem, acting under MCR 7.211(E)(2), orders:
The motion to supplement brief on appeal with issue and supplemental authority is GRANTED TO THE EXTENT that the supplemental brief submitted with the motion on March 18, 2022 is accepted for filing. In all other respects the motion is DENIED without prejudice to defendant-appellant making appropriate filings as to the relevant matters. First, to seek a remand as to an additional matter, defendant-appellant should file either a new motion to remand or a motion to supplement the pending motion to remand. Such a request is not appropriately included in an administrative motion to file a supplemental brief. Second, as to the wish to address new authority from the Michigan Supreme Court as to an issue already raised in appellant's brief, defendant-appellant should file a supplemental authority filing under MCR 7.212(F).
The time for filing plaintiff-appellee's brief under MCR 7.212(A)(2)(a)(ii) shall run from the date of this order.
