Opinion

7-22-2003

THE PEOPLE, Plaintiff and Respondent, v. MIGUEL GONZAGA RAMIREZ, Defendant and Appellant.

Linn Davis, under appointment by the Court of Appeal, for Defendant and Appellant. No appearance for Plaintiff and Respondent.

On November 8, 2002, pursuant to Penal Code section 859a, Miguel Gonzaga (defendant), represented by counsel, pled guilty to counts 1 and 2, gross vehicular manslaughter (Pen. Code, § 191.5, subd. (a)), of the felony complaint filed by the Riverside County District Attorney.

Thereafter, and in accordance with the negotiated disposition, defendant was committed to state prison for eight years, less custody credits, and the remaining counts were dismissed on motion of the district attorney and in the interests of justice pursuant to Penal Code section 1385.

Defendant appealed and upon his request, this court appointed counsel to represent him. Counsel has filed a brief under the authority of People v. Wende (1979) 25 Cal.3d 436, 158 Cal. Rptr. 839, 600 P.2d 1071 and Anders v. California (1967) 386 U.S. 738 [87 S. Ct. 1396, 18 L. Ed. 2d 493], setting forth a statement of the case, a summary of the facts, and requesting this court to undertake a review of the entire record.

We offered defendant an opportunity to file a personal supplemental brief, which he has not done.

We have now concluded our independent review of the record and find no arguable issues.

The judgment is affirmed.

We concur: McKINSTER, J., RICHLI, J.
