Supreme Court of Michigan
Oct 13, 1998
459 Mich. 878 (Mich. 1998)

Opinion

No. 113036.

October 13, 1998.

Summary Disposition October 13, 1998.

In lieu of granting leave to appeal, the judgments of the Court of Appeals and the Recorder's Court are reversed, and the matter is remanded to the Wayne Circuit Court for further proceedings. MCR 7.302(F)(1). The evidence presented by the prosecution was sufficient to authenticate the documents in question. The stay that was entered by the Supreme Court on September 10, 1998, is vacated.

Court of Appeals No. 204278.

Reconsideration denied December 30, 1998.

CAVANAGH, J.

I would grant the motion for reconsideration. Pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, I would remand the case to the trial court for further factual findings. I would insturct the trial court to take the testimony of Judge John E. MacDonald in order to determine whether he recalls signing the warrants in the present case and whether he can verify the signature contained on the various search warrants are its own.
