Appellate Division of the Supreme Court of New York, Second Department
Nov 5, 2008
56 A.D.3d 495 (N.Y. App. Div. 2008)

Opinion

No. 2007-09466.

November 5, 2008.

Appeal by the defendant from a judgment of the Supreme Court, Suffolk County (R. Doyle, J.), rendered September 18, 2007, convicting her of grand larceny in the fourth degree and criminal possession of stolen property in the fourth degree, upon her plea of guilty, and imposing sentence.

Robert C. Mitchell, Riverhead, N.Y. (James H. Miller III of counsel), for appellant.

Thomas J. Spota, District Attorney, Riverhead, N.Y. (Steven A. Hovani of counsel), for respondent.

Rivera, J.P., Florio, Angiolillo, McCarthy and Chambers, JJ.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631; cf. People v Gonzalez, 47 NY2d 606).
