On argument, judgment of the Court of Special Sessions of the City of New York, Borough of Brooklyn, convicting defendant of a violation of section 2040 of the Penal Law (willful violation of the terms of a lease), reversed on the law, the information dismissed and defendant discharged. The proof did not establish a violation of section 2040 of the Penal Law. Nolan, P.J., Carswell, Johnston, Wenzel and MacCrate, JJ., concur.
