Appellant having moved for a writ of error coram nobis vacating the order of this Court entered October 2, 2009 affirming a judgment of Supreme Court, Erie County rendered March 7, 2005,

Now, upon reading and filing the affidavit of Tyrone Prescott sworn to July 11, 2011, the notice of motion with proof of service thereof, the affidavit of Matthew B. Powers, Esq. sworn to August 3, 2011, and due deliberation having been had thereon,
