People v. Powell

Supreme Court of Michigan
Sep 27, 2000
463 Mich. 885 (Mich. 2000)

Opinion

No. 116921.

September 27, 2000.

COA: 209533, Michigan, Recorder's Ct: 95-007297.

On order of the Court, the application for leave to appeal from the April 28, 2000, decision of the Court of Appeals is considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the judgment of the Court of Appeals and REMAND this case to the Court of Appeals for reconsideration in light of People v Carines, 460 Mich. 750 (1999). We also direct the Court of Appeals to consider whether evidence regarding the police officer's actions in other matters was collateral under People v Brownridge, 459 Mich. 456 (1999), because of a lack of sufficient foundation here.
