Appellate Division of the Supreme Court of New York, Second Department
Jan 10, 2006
25 A.D.3d 573 (N.Y. App. Div. 2006)

Opinion

2003-05372.

January 10, 2006.

Appeal by the defendant from a judgment of the Supreme Court, Westchester County (DiFiore, J.), rendered May 12, 2003, convicting him of attempted murder in the second degree, upon his plea of guilty, and imposing sentence.

David J. Squirrell, Mount Kisco, N.Y., for appellant.

Jeanine Pirro, District Attorney, White Plains, N.Y. (Jamie E. Fair and Richard Longworth Hecht of counsel), for respondent.

Before: H. Miller, J.P., Crane, Krausman, Rivera and Lifson, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v. California, 386 US 738; People v. Paige, 54 AD2d 631; cf. People v. Gonzalez, 47 NY2d 606).
