People v. Phung

Supreme Court of Michigan
Jan 23, 2002
465 Mich. 950 (Mich. 2002)

Opinion

No. 119344.

January 23, 2002.

COA: 232603, Iosco CC: 00-004017-FC

On order of the Court, the delayed application for leave to appeal from the April 9, 2001 decision of the Court of Appeals is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for consideration as on leave granted. The Court of Appeals is also directed to determine whether the trial court's focus on the ethnicity of the victims and the defendant was appropriate to justify an increased sentence where it appears that defendant's consideration of the victims' ethnicity was based on his perception of the relative ease of stealing from persons of such ethnicity.
