¶ 4 The appellate court has set forth the underlying facts of this case in defendant's prior appeals. See People v. Phelps, 2019 IL App (4th) 160560-U; People v. Phelps, 4-22-0221 (2023) (unpublished summary order under Illinois Supreme Court Rule 23); People v. Phelps, 2024 IL App (4th) 230701-U. Accordingly, we recite only those facts necessary to resolve the issues presented in this appeal.
