People v. Peterson

Appellate Division of the Supreme Court of New York, Second Department
Jul 19, 1999
263 A.D.2d 518 (N.Y. App. Div. 1999)

Opinion

Argued May 27, 1999

July 19, 1999

Appeal by the defendant from a judgment of the Supreme Court, Kings County (Douglass, J.), rendered May 3, 1995, convicting him of murder in the second degree, upon a jury verdict, and imposing sentence.

Carl W. Thomas, Brooklyn, N.Y., for appellant.

Charles J. Hynes, District Attorney, Brooklyn, N.Y. (Roseann B. MacKechnie and Anthea H. Bruffee of counsel), for respondent.

CORNELIUS J. O'BRIEN, J.P., THOMAS R. SULLIVAN, DANIEL W. JOY, NANCY E. SMITH, JJ.

DECISION ORDER

ORDERED that the judgment is affirmed.

Viewing the evidence in the light most favorable to the prosecution ( see, People v. Contes, 60 N.Y.2d 620), we find that it was legally sufficient to establish the defendant's guilt beyond a reasonable doubt. Moreover, upon the exercise of our factual review power, we are satisfied that the verdict of guilt was not against the weight of the evidence ( see, CPL 470.15).

The defendant's remaining contentions are either unpreserved for appellate review or without merit.
