By order of August 28, 2001, the delayed application for leave to appeal from the January 16, 2001 decision of the Court of Appeals was held in abeyance pending the decision in People v Krueger, (Docket No. 117375).

On order of the Court, the decision having been issued on April 24, 2002, 466 Mich. 50 (2002), the delayed application is again considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.

Cavanagh, Taylor, and Markman, JJ., would grant leave to appeal.
