People v. Perry

Supreme Court of Michigan
Dec 5, 2000
463 Mich. 927 (Mich. 2000)

Opinion

No. 117321.

December 5, 2000.

COA: 220279, Wayne CC: 99-002417

On order of the Court, the application for leave to appeal from the April 21, 2000, decision of the Court of Appeals is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REVERSE the judgments of the Court of Appeals and Wayne Circuit Court and REMAND this case to the Wayne Circuit Court for further proceedings. The information in the search warrant affidavit indicating that when the police informant asked to buy crack cocaine from the suspect he responded, "I don't know you, bring back someone I know and I will sell to you," and subsequent police surveillance of the premises that disclosed visitor traffic consistent with drug dealing, provided a substantial basis for the magistrate's decision to issue a search warrant. People v Whitfield, 461 Mich. 441 (2000).

Cavanagh and Kelly, JJ., would deny leave to appeal.
