People v. Perry

Appellate Division of the Supreme Court of New York, First Department
Apr 30, 1998
249 A.D.2d 238 (N.Y. App. Div. 1998)

Opinion

April 30, 1998

Appeal from the Supreme Court, New York County (Jeffrey Atlas, J.).

Defendant's suppression motion was properly denied. We see no reason to disturb the court's credibility determinations ( see, People v. Prochilo, 41 N.Y.2d 759, 761).

Concur — Milonas, J.P., Wallach, Tom, Mazzarelli and Saxe, JJ.
