People v. Perkins

Appellate Division of the Supreme Court of New York, First Department
Jan 6, 2000
268 A.D.2d 227 (N.Y. App. Div. 2000)

Opinion

January 6, 2000

Judgment, Supreme Court, New York County (Ira Beal, J.), rendered October 10, 1997, convicting defendant, after a jury trial, of burglary in the second degree, and sentencing him to a term of 2 1/2 to 5 years, unanimously affirmed.

Elizabeth Nochlin, for respondent.

Lori Shellenberger, for defendant-appellant.

SULLIVAN, J.P., MAZZARELLI, WALLACH, RUBIN, ANDRIAS, JJ.

The verdict was based on legally sufficient evidence and was not against the weight of the evidence. We see no reason to disturb the jury's determination concerning the credibility of witnesses and reliability of identification testimony.

THIS CONSTITUTES THE DECISION AND ORDER OF SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
