Appellant's “Application to Strike Argument 9 from Appellant's Supplemental Opening Brief,” filed September 7, 2022, is construed as a motion to withdraw appellant's supplemental opening brief filed April 11, 2022, and as such is granted.

Appellant is directed to serve and file, on or before November 14, 2022, a supplemental opening brief omitting what was styled as “Argument 9,” spanning pages 204 through 260, of the supplemental opening brief filed April 11, 2022. The October 25, 2022 due date for respondent's brief is vacated. Respondent is directed to file a respondent's brief within 60 days of the filing of appellant's supplemental opening brief. Appellant may file a reply brief within 60 days of the filing of respondent's brief.

Corrigan, J., was absent and did not participate.
