G028325 California Court of Appeal, Fourth District, Third Division November 21, 2002[Modification of opinion (103 Cal.App.4th 203; 126 Cal.Rptr.2d 505) on denial of petition for rehearing.]
This modification requires editorial changes to the second paragraph of the summary, page 203. In the bound volume report, the first sentence will be changed to read, "The Court of Appeal reversed the judgment of conviction of possession of products containing hydriotic acid with intent to manufacture methamphetamine, remanded for a new trial, and affirmed the judgment in all other respects."
OPINION
MOORE, J.
IT IS ORDERED that the published opinion filed on October 29, 2002, be modified as follows:
1. On the caption page, delete the second sentence in the first full paragraph and replace it with the following sentence:
Affirmed in part, reversed in part, and remanded.
2. On page 2 [103 Cal.App.4th 206, advance report, line 2], delete the final sentence of the third full paragraph and replace it with the following sentence:
Thus, the judgment is reversed as to count one and the cause remanded for a new trial.
3. On page 7, delete the last full sentence of the page, under the heading "Disposition" [103 Cal.App.4th 209, advance report], and replace it with the following sentences:
The judgment is reversed as to count one and the cause remanded for a new trial. In all other respects, the judgment is affirmed.
The petition for rehearing is DENIED. This modification does not effect a change in the judgment.
