THE PEOPLE OF THE STATE OF NEW YORK, Appellant, v. ALEX PEREZ, Respondent.


DECISION AND ORDER ON MOTION

An application having been made by defendant pursuant to section 460.60 of the Criminal Procedure Law for an order staying execution of the judgment of the County Court, Albany County, and continuing bail pending determination of defendant's appeal to the Court of Appeals;

NOW, on reading the papers filed in support of the application and the papers filed in opposition thereto, it is

ORDERED that the application be and the same hereby is granted and bail is continued at $82,500 cash or insurance company bail bond, and it is further

ORDERED that defendant shall inform this Court within 24 hours in the event he is charged with violating any provision of the Penal Law and/or Vehicle and Traffic Law, and it is further

ORDERED that defendant shall remain within the State of New York at all times during the pendency of his appeal, and it is further

ORDERED that defendant shall surrender any passport possessed by him to the Clerk of this Court, and it is further

ORDERED that defendant stay away and have no contact, direct or indirect, with Matthew Sherman or Nicholas Volmer.
