Opinion

The PEOPLE of the State of New York, Respondent, v. Freddie PEREZ, Defendant–Appellant.

Seymour W. James, Jr., The Legal Aid Society, New York (Kristina Schwarz of counsel), for appellant. Cyrus R. Vance, Jr., District Attorney, New York (Frank Glaser of counsel), for respondent.

Seymour W. James, Jr., The Legal Aid Society, New York (Kristina Schwarz of counsel), for appellant.

Cyrus R. Vance, Jr., District Attorney, New York (Frank Glaser of counsel), for respondent.

Judgment of resentence, Supreme Court, New York County (Bonnie G. Wittner, J.), rendered April 25, 2012, resentencing defendant to a term of five years, with five years' postrelease supervision, unanimously affirmed.

The resentencing proceeding imposing a term of postrelease supervision was neither barred by double jeopardy nor otherwise unlawful (People v. Lingle, 16 N.Y.3d 621, 926 N.Y.S.2d 4, 949 N.E.2d 952 [2011] ).

Defendant's challenge to the voluntariness of the underlying plea is not properly before this Court on this appeal from the judgment of resentence (see People v. Toney, 116 A.D.3d 607, 983 N.Y.S.2d 797 [1st Dept.2014], lv. denied 23 N.Y.3d 1043, 993 N.Y.S.2d 257, 17 N.E.3d 512 [2014] ; CPL 450.30[3] ).

RENWICK, J.P., MOSKOWITZ, KAPNICK, KAHN, GESMER, JJ., concur.
