Appeal from the Supreme Court, Queens County (Leahy, J.).


Ordered that the judgment is affirmed.

The defendant waived his current claim that the trial court erred in swearing in the venirepersons as a panel (see, People v. Ortiz, 69 A.D.2d 825). In any event, the contention is without merit.

The sentence imposed was neither harsh nor excessive (see, People v. Suitte, 90 A.D.2d 80). Sullivan, J.P., O'Brien, Altman and Goldstein, JJ., concur.
