On order of the Court, the application for leave to appeal from the August 15, 2002 decision of the Court of Appeals and the motions to remand and for immediate consideration are considered. The motion for immediate consideration is GRANTED, but only to the extent that defendant's application has been given expedited consideration. The application for leave to appeal is DENIED, because the defendant has failed to meet the burden of establishing entitlement to relief under MCR 6.508(D). The motion to remand is also DENIED.
