Motion by the defendant for leave to appeal to this Court from an order of the Supreme Court, Nassau County, rendered February 19, 2010, denying his motion pursuant to CPL 240.20.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied as the order is not appealable either by right or by permission (see CPL 450.10, 450.15).
