An order of this Court having been entered on November 12, 2019 (M-7513), inter alia, assigning Janet E. Sabel, Esq., predecessor to Twyla Carter, Esq., The Legal Aid Society, as counsel to prosecute defendant's appeal taken from an order of the Supreme Court, New York County, entered on or about August 09, 2019,

And, assigned counsel having moved for an order abating the appeal by reason of appellant's death, and remanding the matter to the trial court to vacate the aforesaid order, with instructions to vacate the Sex Offender Registration Act risk level designation, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied, with leave to renew, upon a showing that defendant's name has been removed from the New York State Sex Offender Registry, or that counsel pursued administrative efforts to remove defendant's name from the registry.
