People v. Parker

Appellate Division of the Supreme Court of New York, First Department
Dec 5, 2000
278 A.D.2d 4 (N.Y. App. Div. 2000)

Opinion

December 5, 2000.

Judgment, Supreme Court, Bronx County (Richard Price, J.), rendered May 18, 1998, convicting defendant, after a jury trial, of criminal possession of a weapon in the third degree, and sentencing him to a term of 7 years, unanimously affirmed.

Kimberly T. Morgan, for respondent.

Cheryl Williams, for defendant-appellant.

Before: Sullivan, P.J., Rosenberger, Nardelli, Tom, Lerner, JJ.

Defendant failed to meet his burden in support of his challenges for cause to three prospective jurors (see, People v. Morgan, 265 A.D.2d 230, 94 N.Y.2d 905). Defendant's inquiries of these jurors were too limited and ambiguous to form a basis upon which to conclude that any of the jurors were biased, and defendant made no effort to expand these inquiries.

THIS CONSTITUTES THE DECISION AND ORDER OF SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
