ORDERED that the decision and order on motion of this Court dated December 13, 2021, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:
Appeal from a judgment of the Supreme Court, Queens County, rendered March 12, 2019, which was determined by decision and order of this Court dated August 25, 2021. Motion by the appellant, pursuant to CPL 460.20, for a certificate granting leave to appeal to the Court of Appeals from the decision and order of this Court.
