DECISION & ORDER ON MOTION

Motion by appellant pro se on an appeal from a judgment of conviction of the City Court of Middletown, Orange County, rendered September 3, 2015, for leave to reargue her prior motion for leave to serve and file a pro se supplemental brief, which was determined by decision and order on motion of this court dated January 23, 2017.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted and, upon reargument, this court's decision and order on motion dated January 23, 2017 is recalled and vacated, the motion for leave to serve and file a pro se supplemental brief is granted, and the supplemental brief shall be served and filed within 21 days of the date of this decision and order on motion; and it is further,

ORDERED that respondent shall have 14 days from the date that the supplemental brief is due to be served in which to serve and file a brief in response to the supplemental brief.
