PEOPLE OF THE STATE OF MICHIGAN, Plaintiff-Appellee, v. DARWIN DAVELL PAGE, Defendant-Appellant.

Genesee CC: 92-047847-FC

Elizabeth T. Clement, Chief Justice, Brian K. Zahra, David F. Viviano, Richard H. Bernstein, Megan K. Cavanagh, Elizabeth M. Welch, Kyra H. Bolden, Justices

ORDER

By order of January 25, 2023, the prosecuting attorney was directed to answer the defendant's motion for immediate consideration. On order of the Court, the answer having been received, the motion for immediate consideration and the application for leave to appeal are again considered, and the motion for immediate consideration is GRANTED. The application for leave to appeal the October 22, 2021 order of the Court of Appeals is DENIED, because the defendant's motion for relief from judgment is prohibited by MCR 6.502(G). This Court's denial is limited to the issues the defendant raised in the particular motion for relief from judgment under this Court's review and is without prejudice to the defendant pursuing relief in the trial court under People v Stovall, 510 Mich. ___ (2022) (Docket No. 162425).
