Defendant having moved pursuant to CPL 460.10(6) to extend the time to serve a notice of appeal from a judgment of the Ontario County Court, rendered August 10, 2011,

Now, upon reading and filing the affirmation of Jonathan Lorge, Esq. dated February 13, 2012, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the notice of appeal served upon the Ontario County District Attorney on September 14, 2011 is hereby deemed timely served.
