Opinion

2d Crim. No. B168319.

11-24-2003

THE PEOPLE, Plaintiff and Respondent, v. VICTOR ORTIZ, Defendant and Appellant.

Suzan E. Hier, under appointment by the Court of Appeal, for Defendant and Appellant. No appearance for Plaintiff and Respondent.

Victor Ortiz appeals from the judgment entered following his plea of guilty to attempted second degree robbery. (Pen. Code, §§ 664, 211.) The trial court sentenced appellant to the low term of 16 months in state prison and imposed various restitution fines. (Id., §§ 1202.4, subds. (a) & (b), 1202.45.) Appellant did not obtain a certificate of probable cause.

We appointed counsel to represent him in this appeal. After examination of the record, counsel filed an opening brief in which no issues were raised.

On September 30, 2003, we advised appellant that he had 30 days within which to personally submit any contentions or issues which he wished us to consider. No response has been received to date.

We have examined the entire record and are satisfied that appellants attorney has fully complied with her responsibilities and that no arguable issues exist. (People v. Wende (1979) 25 Cal.3d 436, 441.)

The judgment is affirmed.

We concur: GILBERT, P.J., PERREN, J.
